OVERGEAR CONTENT MODERATION AND USER-GENERATED CONTENT POLICY

OVERGEAR LIMITED (“Overgear,” “we,” “us,” or “our”) respects our Users' rights. This Overgear Content Moderation and User-Generated Content Policy (hereinafter referred to as the “Content Policy”) is an integral part of the Overgear Terms and Conditions (hereinafter referred to as the “User Agreement”) and applies to all User-Generated Content—including chat messages, reviews, profile information, usernames, uploaded images, bundle names and any other materials posted on the Overgear Platform. It is designed to ensure a safe, lawful, and respectful community while supporting the overall framework of our User Agreement.

1. Purpose and Scope
Overgear is committed to providing a secure and respectful environment for all Users. This Content Policy governs the creation, posting, and management of User-Generated content on the Platform. It applies in conjunction with the User Agreement, Privacy Policy, and other related policies.

2. Prohibited Content
Users must not post any content that:
  • Violates Laws or Rights: Infringes on copyright, trademark, right of publicity/likeness, intellectual property, or any applicable laws.
  • Contains Abusive or Harmful Material: Including, but not limited to, racism, homophobia, transphobia, xenophobia, discrimination based on race, gender, sexual orientation, religion or disability, bullying, harassment, sexual harassment, sexism, defamation, fraud, misinformation, and incitement to violence or self-harm.
  • Promotes Illicit Activities: Encourages scams, gambling, unauthorized or illegal services, or other fraudulent activities.
  • Reveals Confidential Information: Discloses personal, confidential, or sensitive data of others without consent.
  • Is Explicit or Inappropriate: Contains explicit sexual content or material that violates community standards.
  • Misleads or is False: Contains false or misleading statements that may lead to disputes or breach the Platform’s User Agreement, other related documents and applicable laws.

3. Moderation Procedures
  • Overgear utilizes AI-based tools, keyword filters, and anti-spam systems for initial content screening; such AI algorithms do not render final decisions on content removal without the review and approval of a human moderator.
  • A dedicated moderation team conducts both proactive reviews and reactive investigations based on User reports.
  • Content flagged by Users shall ordinarily be reviewed within an estimated 24–48-hour period and may, where necessary or under other circumstances, be extended at Overgear’s sole discretion. If such flagged content also gives rise to disputes under the User Agreement, the Overgear Arbitration process is available as a neutral review mechanism.

4. Reporting Violations
Users can report violations using the following channels:
  • Use the built-in reporting tools available throughout the Platform.
  • Send detailed reports to support@overgear.com.
All reports will be handled in accordance with the dispute resolution procedures outlined in Overgear’s User Agreement.

5. Enforcement and Sanctions
When content or behavior violates this Content Policy, Overgear may take one or more of the following actions:
  • Delete or edit offending content.
  • Issue warnings or temporarily suspend a User’s Account.
  • Permanently block a User’s Profile if violations persist.
  • Apply fines or deduct payments from the Seller’s Overgear Wallet for publishing unlawful, abusive, or otherwise prohibited content, in accordance with Section 3.4 (“Prohibited Content and Sanctions”) and Section 10.2 (“Sanctions and Withholdings”) of the User Agreement.
  • Report about severe violations to the appropriate legal or regulatory bodies.
These measures align with the sanctions provisions outlined in our User Agreement.

6. Appeals and Transparency
  • Users who disagree with a moderation decision may submit an appeal through the official Overgear Customer Support at support@overgear.com.
  • Overgear will notify Users of the outcome of appeals and provide reasons for any enforcement actions taken.
7. DMCA and Intellectual Property Complaints
  • If you believe your intellectual property rights have been infringed upon, please submit a formal DMCA notice or equivalent complaint using the DMCA Policy provided on the Platform.
  • Overgear will promptly review valid complaints and take appropriate action, consistent with the intellectual property rights section of the User Agreement.
8. User Accountability and Indemnification
  • Users are solely responsible for all content they post. Any content that causes harm or infringes on third-party rights may subject the User to indemnification obligations, and Overgear may hold the User liable for any damages or losses suffered by third parties as a result of such content.”.
  • As stated in the Overgear User Agreement, Users must comply with all applicable rules, and failure to do so may result in sanctions, including financial penalties and legal action.
9. Data Privacy in Moderation
  • Any data collected during the moderation process (such as reports, metadata, and correspondence) will be processed in strict accordance with our Privacy Policy and applicable data protection laws.
  • Overgear employs industry-standard security practices to protect all information related to moderation and dispute resolution.
10. Integration with Dispute Resolution
  • Content-related disputes that cannot be resolved through standard moderation are integrated into the Overgear Arbitration process, ensuring that all disputes—whether regarding transactions or content—are managed under a consistent set of procedures.
  • Overgear Arbitration serves as a neutral intermediary to facilitate fair resolution, in line with the detailed dispute resolution process in the User Agreement.
11. Disclaimer
While Overgear is not directly liable for User-Generated Content, we are committed to promptly investigating and addressing violations in a manner consistent with our User Agreement. Overgear disclaims liability for content posted by Users but will take action against material that violates this Content Policy or applicable law.

This integrated Content Policy is intended to balance the freedom of expression with the need to maintain a secure, lawful, and respectful environment for all members of the Overgear community.
